Participants retain ownership of their intellectual property. However, by submitting an entry, participants grant Atharva Group of Institutes a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the submitted materials for promotional and archival purposes related to the awards. Participants acknowledge that they are submitting their work freely and without infringing any third-party rights.
Plagiarism:
Any submission found to be plagiarized or not original to the participant will result in immediate disqualification and revocation of candidature. The participant shall bear full responsibility for any infringement of intellectual property rights (IPR). By submitting an entry, participants warrant that their work is free from IPR violations and agree to indemnify the organizers against any legal claims arising from such violations.
Media Rights and Publicity Clause:
By participating, entrants grant the organizers the right to use their work, name, image, and likeness in media, including photos and videos, for promotional and publicity purposes. Participants consent to the use of such materials without compensation, acknowledging that their submissions may be publicly displayed.
Non-Discrimination & Equal Opportunity Clause (Protection of the Institute):
The Atharva Awards for Excellence in Research, Technology & Innovation is committed to providing equal opportunities to all participants, regardless of gender, race, religion, or any other protected characteristic under applicable anti-discrimination laws. The competition is conducted in compliance with all relevant national and local equal opportunity regulations. The organizers reserve the right to make final decisions regarding eligibility and awards, and all participants agree to accept these decisions without legal recourse.
Indemnification:
Participants agree to indemnify and hold harmless Atharva Group of Institutes, its affiliates, employees, and representatives from any claims, damages, liabilities, and expenses (including legal fees) arising out of or in connection with their participation in the awards, including but not limited to any claims of infringement of intellectual property rights, plagiarism, or breach of these guidelines.
Competition Integrity Clause:
Participants agree to uphold the highest standards of ethical behavior, ensuring no unfair means, including bribery or cheating, are employed during the competition. Any violation of these ethical standards will result in immediate disqualification. The organizers reserve the right to take final action in such cases without recourse.
Travel Insurance
Awardees / Shortlisted candidates are responsible for obtaining their own travel insurance to cover any unforeseen circumstances, including but not limited to, medical emergencies, trip cancellations, or loss of personal belongings, during their travel to and stay in Mumbai for the awards ceremony. Atharva Group of Institutes will not be held liable for any costs or losses incurred due to the absence of travel insurance.
Taxation and Financial Compliance Clause:
The award prize of ₹50,000 (or any other monetary reward) is subject to applicable income tax as per prevailing tax laws. Awardees are solely responsible for any taxes, deductions, or levies imposed on the prize amount. The organizers shall not be liable for any tax obligations, and winners must comply with all relevant tax regulations in connection with the prize.
Liability Limitation:
Atharva Group of Institutes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the awards. The total liability of Atharva Group of Institutes shall not exceed the amount of the award prize.
Force Majeure Clause:
The Organizers shall not be held liable for any failure or delay in the performance of their obligations under this competition arising from events beyond their reasonable control, including, without limitation, acts of God, natural disasters, strikes, lockouts, pandemics, wars, governmental actions, or any other unforeseen circumstances. In the event of such occurrences, the Organizers reserve the right to suspend, modify, or cancel the competition, and shall not be liable for any loss or damage resulting therefrom.
Governing Law:
These guidelines and any disputes arising out of or related to the awards shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding shall be brought exclusively in the courts located in Mumbai, Maharashtra.
Amendments and Modifications Clause:
The Organizing Committee reserves the right to modify, amend, or update the rules, guidelines, or deadlines of the competition at its sole discretion, as deemed necessary. Any such modifications will be communicated to participants in a timely manner, and participants agree to comply with the revised terms.
